Due to customer feedback, we have re-designed our Selling Agency Authorities to be simpler to complete whilst still complying with all Legislative Requirements, especially in respect to Disclosures and Warnings.

It is important to point out that some information MUST be presented in an Agency Authority as prescribed by the Estate Agents Act 1980 and in the approved form (ie. in the format as provided by the Director of Consumer Affairs Victoria).

Information that MUST Form Part of an Agency Authority (in the approved form) is as follows:

  • Estimated Selling Price (Section 47a of the Act)
  • Term of Sole Agency (Section 54 of the Act)
  • Commission Percentage & Dollar Value (Section 49A(1)(c)(i) & (ii) of the Act)
  • Disclosure of Commission Sharing (Section 48 of the Act)
  • Advice About Complaints Concerning Commission (Section 49A(1)(c)(iv) of the Act)
  • Rebate Statement (Section 49A(1)(c)(iii) & 49A(4))

We have taken particular care to ensure that ADL's Sales Agency Authorities are compliant with legislation, incorporating approved forms of information where required. Such care is paramount in helping to ensure our clients' stake in a property transaction (ie. safeguarding your commission).

To ensure that you are using the latest forms, click on the 'Update' button within the Main Menu of ADLForms:

1. Initialling Sections in Sales Agency Authorities page footers are now optional when printing or saving to PDF.

Normally in Sales Contracts and Agency Authorities it is good business practice to have all parties initial each page of an agreement to indicate they have read all pages. This provides supporting evidence in a court of law (when the situation arises) that the client was aware of and had read every page in the agreement.

For this purpose ADL Contracts and Agency Authorities have had a section in the footer of all pages for initialling.

Even though initialling pages is best business practice, but not absolutely necessary under legislation, many agents would prefer NOT to follow this practice. To accommodate this possibility we have made the printing of these sections optional at time of printing.

When printing, or saving to PDF, the new Selling Agency Authorities you will be given the option to NOT print these sections. ADLForms will remember your choice and make that choice the default next time you print a form with Initialling Sections.

When printing, you will be able to turn off the printing of Initialling Sections in the Print Dialog box:

When saving to PDF, you will be prompted as to whether you wish to print the Initialling Sections:

This new feature will soon be available in the Leasing & Managing Agency Authorities and the Contract of Sale of Real Estate.

2. Changes, similar to those mentioned above for Sales Agency Authorities, will soon apply to ADLForms' Leasing and Managing Agency Authorities.

These simpler Authorities will be released within the next week. ADLForms will automatically download and install these forms to your computer when this occurs.
