The Queensland Government has initiated a review of the Residential Tenancies & Rooming Accommodation Act 2008.
A review to improve the balance of fairness in respect to tenancy legislation is certainly overdue and will be welcomed by the industry, but recent form changes could easily have been put on hold until after the review is completed.
The Government is inviting you to have your say in the review process which is designed to:
- ensure the Act is meeting its objective of fairly balancing stakeholder interests,
- ensure there are no legislative barriers to improved service delivery by the RTA, and
- remove red tape or redundant provisions.

Those wishing to make a submission must do so by 2 January 2013. ADL will not be making a submission on behalf of its clients at this time.
1. As a result of continuing consultation with the Residential Tenancies Authority (RTA) we have implemented changes to Special Terms provided by ADL in 'Addendum B - Special Terms' of our 18a General Tenancy Agreements (with extra terms).
We have amended the wording in some of the Special Terms to provide further clarity to both parties.
The RTA feel that such special terms are unnecessary due to the Tenant having a general obligation under Section 188 of the Act. We however also have an obligation to our clients and will continue to provide these terms, as we feel they provide greater clarity to the parties concerning these obligations under the agreement.
The updated 18a General Tenancy Agreements (with extra terms) are now ready for use in ADLForms.

2. The following forms are now ready for use in ADLForms thanks to valuable customer feedback:
Amended Forms:
- Body Corporate Search Authority - updated to the new ADL format as well as making the information in the form easier to understand.
- Tenant's Confirmation Form - updated so that it can now be used for Rooming Accommodation and Moveable Dwelling tenancies as well as residential ones.
