Due to changes to the Body Corporate and Community Management Act 1997 (BCCM), which come into effect today (1st August 2013), changes have been made to all Sales Contracts for Lots in a Community Title Scheme.

The Body Corporate and Community Management and Other Legislation Amendment Act 2013 has removed the requirement for the Seller to provide to the Buyer a copy of the current Community Management Statement (CMS) for the Scheme with the Sales Contract.

To provide continuing protection to the Buyer in respect of the CMS we have changed Item 11 (Inspections) and related clauses (of both the Residential & Commercial Sales Contracts). The Item now allows for the Buyer to obtain a copy of the Registered CMS from the relevant Authority to satisfy themselves in relation to its contents.

Guarantees made by the Seller in respect to decisions made by the Body Corporate after the signing of the Sales Contract and before Settlement, which formed part of the previous versions of our Sales Contracts, remain in effect in the new versions.

Forms that have changed are:

  • Contract for Sales of Residential Lots in a Community Titles Scheme (With Warning)
  • Contract for Sales of Residential Lots in a Community Titles Scheme (Auction)
  • Contract for Sales of Commercial Lots in a Community Titles Scheme

The BCCM Form 14 has also changed to reflect the changes to the Act and forms part of the Sales Contracts in ADLForms.
