Hi,

On the back of valuable feedback from ADL clients we have made a number of changes to our Property Management Agency Agreements.

The changes will make ADL Property Management Agency Agreements more relevant for use within the industry and will offer better protection for agents.

The key changes we have implemented are:

  • Added a provision for permitted pets in the 'Property' item.
  • Added a new 'Termination' clause
  • Added a sub-item, 'Explanation of Fees', under the 'Fees for Services' item to be used where the Agent has inserted non-standard fees which may require further explanatory details
  • Increased the number of possible payees in respect of rent disbursements in item 'Rent and Statements' from 1 to 3
  • Increased the number of possible recipients of statements in item 'Rent and Statements' from 2 to 3
  • Added a provision for the 'Owner's Authorised Representative' to sign the agreement in item 'Signatures'
  • Updated or added definitions as follows:
    • Additional Services Fee
    • Administration Fee (Added)
    • Agreement
    • Lease Renewal Fee (Changed from Letting Renewal Fee and updated)
    • Letting Fee (Added)
    • Management Fee
    • Material Fact
    • Rent (Added)
  • Merged clause 'Exclusive Appointment' with clause 'Appointment of Agent' and added a new sub-clause
  • Improved the 'Agent's Obligations and Authority' clause in respect of:
    • Caretaking and maintenance
    • Inspections
    • Choosing tenants
    • Negotiating and signing tenancy agreements
  • Changed clause 'Agent’s Fees and Remuneration' to 'Agent’s Fees and Reimbursement' and made multiple improvements to the clause

In addition to the above changes we have:

  • Merged our 'Exclusive Holiday Letting' agreement (AUNSWREPM008) and 'Open Holiday Letting' agreement (AUNSWREPM031) into a new form 'Management and/or Letting Agency Agreement (Holiday Letting)' (AUNSWREPM066) with an option to specify whether the agreement is Exclusive or Non-Exclusive. AUNSWREPM008 and AUNSWREPM031 have been removed entirely.
  • Removed 'Exclusive Management Agency Agreement (Residential - Excluding Insurance Item)' (AUNSWREPM012). The form to use in place of this agreement is 'Exclusive Management Agency Agreement (Residential)’ (AUNSWREPM010).
  • Removed 'Exclusive Management Agency Agreement (Residential - Multiple Owners)' (AUNSWREPM033). The form to use in place of this agreement is 'Exclusive Management Agency Agreement (Residential)’ (AUNSWREPM010), which now has accommodation for multiple owners.

  • AUNSWREPM010 Exclusive Management Agency Agreement (Residential)
  • AUNSWREPM016 Exclusive or Open Leasing Agency Agreement (Residential)
  • AUNSWREPM053 Exclusive Management Agency Agreement (Short Term and/or Residential Tenancy)
  • AUNSWREPM066 Exclusive or Open Management Agency Agreement (Holiday Letting)

1. Updating ADLForms

ADLForms should have automatically updated to allow access to the new forms and the latest version of the software (9.4.6) when you first opened ADLForms today. If this has not occurred then:

  1. Click the 'Update' button from the main menu of the program. Please allow a few minutes for the forms and/or program to download and install.
  2. If this fails to update your forms then:
    • Select Tools -> 'Re-initialise ADLForms’ from within the Main Menu of the ADLForms program. This will close the program.
    • Restart ADLForms and click the 'Update' button.
  3. If you still do not have the updated forms click here to download and re-install ADLForms.
  4. If all the above do not result in a successful forms and program update please contact our tech support team for assistance.
