Hi,
The OFT have updated PO Forms 6 & 7 as part of their annual forms review. These forms are effective today (1st July 2016) and are now included in ADLForms - appropriate changes have been made to all versions of the PO Forms 6 & 7 included in ADLForms.
The main changes to PO Form 6 include an update to 'Part 2 - Licensee Details' and the deletion of the 'Parish/County' field in Part 3. The change in title of two fields in Part 2 may cause some confusion. The Field Title changes are:
- 'Agency Name (if applicable)' changed to 'Trading Name'
- 'Licensee Name' changed to 'Licensee Name (corporation, if applicable)'
We have added a warning to the PO Form 6 in respect of how this section will be automatically populated by ADLForms.
The warning will appear when you open a new PO Form 6.

To be able to use the new PO Form 6 you will need to update to ADLForms V9.3.6 (See below - 3. Updating ADLForms).

1. We have added (effective today) two new Notices to ADLForms, required under sections 458A and 458B of the QLD Residential Tenancies and Rooming Accommodation Act 2008 (the Act).
As we previously
advised in a newsflash from ADL on 22nd June, in addition to the requirement for these notices, sections 459A to 459D of the Act provide for rules in respect of:
- The 'quality' of information held on a tenancy database
- How a tenant may obtain a copy of personal information listed on a tenancy database
- How long information can be maintained on a tenancy database
- When and how a tenant can have information updated on or deleted from a tenancy database
Agents should become familiar with their responsibilities under the new legislative requirements in respect of dealing with prospective tenants and the use of tenancy databases.

The new forms are:
- AUQLDREPM049 Notice to Applicant – Tenancy Databases used by Lessor/Agent
- AUQLDREPM050 Notice to Applicant – Listing on a Residential Tenancy Database
2. As previously advised (ADL Newsflash - 22nd June 2016) new Capital Gains Tax (CGT) Withholding Provisions come into force today (1st July 2016).
For properties valued at or more than $2,000,000 a Buyer must withhold 10% of the purchase price and pay such monies to the Australian Taxation Office (ATO) on or before settlement, unless the Vendor has obtained a Clearance Certificate from the ATO (Taxation Administration Act 1953 (CTH) - Subdivision 14-D).

We have added a new clause to all our sales contracts that outlines the responsibilities of a Buyer in respect of purchases at or over $2,000,000.
These changes have been released today.
The changed forms are:

3. Updating ADLForms
ADLForms should have automatically updated to allow access to the new forms and the latest version of the software (v9.3.6) when you first opened ADLForms today. If this has not occurred then:
- Click the 'Update' button from the main menu of the program. Please allow a few minutes for the forms and/or program to download and install.

If this fails to update your forms then:
- Select Tools -> 'Re-initialise ADLForms’ from within the Main Menu of the ADLForms program. This will close the program.
- Restart ADLForms and click the 'Update' button.
- If you still do not have the updated forms click here to download and re-install ADLForms.
- If all the above do not result in a successful forms and program update please contact our tech support team for assistance.
